WeyMedia Inc. and its affiliates (collectively, "WeyMedia", “us”, “our” or “we”) respect your privacy and are committed to protecting it by complying with this Privacy Policy.

This Privacy Policy is applicable to the services (the "Services") owned wholly or in part by WeyMedia, which include any of our software applications or services, including our GeniusCash Rewards application, Rate Your Wallet application, and our Max Spending application (the “App(s)”), any of our websites, including creditcardGenius.ca and moneyGenius.ca (the "Site(s)"), any of our rewards programs, including our GeniusCash rewards program (the “Rewards Program(s)”), or any other related services.

This Privacy Policy describes how we collect, use and disclose personal information when you use any of our Apps, any of the Sites or any of our Services. Please read this Privacy Policy carefully as, by using the App, these Sites, and Services, you agree that your use of the App, these Sites, and Services is governed by this Privacy Policy.

This Privacy Policy is based on the principles outlined in Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). This Privacy Policy covers only those activities that are subject to the provisions of PIPEDA and provincial privacy laws, as applicable.

We will obtain your consent for the collection of your personal information, and we will only use and disclose your personal information in accordance with this Privacy Policy and our legal obligations. Your consent will be requested either before or at the time your personal information is collected. In certain cases, your consent may be implied in light of the circumstances.

What is personal information?

For the purposes of this Privacy Policy, personal information is any information about an identifiable individual, or information that if combined with other, readily available information, may be used to identify an individual.

What personal information do we collect?

Site visits

You can visit our Sites without telling us who you are or revealing any information about yourself, including your email address. Our web server may collect information related to your visit to our Sites, including personal information: the IP address and domain used to access our Sites; your Internet Service Provider (ISP), the type and version of your browser; the time of your visit to our Sites; the website from which you entered our Sites, and the website to which you exit; any website page that is viewed by that IP address; and what country you are from. We use this information to monitor our Sites’ performance (such as number of visits, average time spent, page views, etc.) and for our business purposes such as working to continually upgrade and improve our Sites and its contents. The amount of information that is sent by your web browser depends upon the browser and settings you use. Please refer to the instructions provided by your browser if you want to learn more about what information it sends to websites you visit, or how you may change or restrict this.

Downloading and using the App

If you download and register to use the App, we will collect your name, email address, phone number, and other information required to allow you to register an account. Depending on how you decide to use the App, we may also collect information relating to your credit card usage and spending, as described in more detail below.

In addition, we collect personal information that may include your full name, email address, age, income information, credit score, or other information (such as your total spending in a month, the breakdown of your monthly spending, or your annual income), that you choose to submit to any of our Apps and Sites in the following ways: email opt-in, account registration, use of our Rate Your Wallet application, use of our Max Spending application, participation in our GeniusCash Rewards Program, and user reviews.

Connection Provider

If you decide to use our Max Spending application, you will connect your bank account and credit cards to your registered App account, using a trusted third party service provider, (note that we currently use Plaid and Flinks (each, a "Connection Provider"). We will not collect or have access to your bank account login information or credentials if you choose to connect your bank accounts and credit cards to use the Max Spending application.

Our Connection Provider will collect, use and disclose your bank account credentials and other personal information in accordance with their privacy policies and your instructions. In order to analyze your spending and to provide you with insights regarding your spending and credit card use, we will collect information from our Connection Provider detailing your card usage and spending, but we will only retain information about your total spending across various categories (for example, "restaurant" or “groceries”) in a given month by account.

By connecting your accounts to the Services using our Connection Provider, you grant WeyMedia and the Connection Provider the right, power, and authority to act on your behalf to access and transmit your personal and financial information from your relevant financial institution. You agree to your personal and financial information being transferred, stored, and processed by the Connection Provider. You also agree that the Connection Provider is not responsible for our Services or for how WeyMedia uses your personal information in connection with our Services. Any claims associated with our Services will be exclusively made against WeyMedia, subject to the Terms of Service, and any claims associated with a Connection Provider’s use of your data will be exclusively made against the Connection Provider

Other use of Services

When you request information or Services from us, we may use the email address that you provide to send you information about offers on products and Services that we believe may be of interest to you. We will only send you commercial electronic messages ("CEMs") where we have your express or implied consent to do so. Your consent to receive CEMs is implied where we have an existing business relationship with you, or you have reached out to us and made an inquiry within a certain time frame. You may unsubscribe from receiving CEMs at any time, by clicking the unsubscribe button on an email or following the direction provided in a text message.

How do we use cookies?

When you visit one of our Sites, we place a "cookie" on the hard drive of your computer to track your visit. A cookie is a small data file that is transferred to your hard drive through your web browser that can only be read by the website that placed the cookie on your hard drive. The cookie acts as an identification card and allows our Sites to identify you and to record your passwords and preferences. The cookie allows us to track your visit to the Sites so that we can better understand your use of our Sites so that we can customize and tailor the Sites to better meet your needs.

Most web browsers are set to accept cookies. However, on most web browsers you may change this setting to have your web browser either: (1) notify you prior to a website placing a cookie on your hard drive so that you can decide whether or not to accept the cookie; or (2) automatically prevent the placing of a cookie on your hard drive. It should be noted that if cookies are not accepted, you may not be able to access a number of web pages found on the Sites.

In addition, because we use third-party advertisements to support these Sites (such as Google AdSense), DART cookies and web beacons may be used by them in order to deliver more relevant interest-based advertising. To opt-out of interest-based advertising, and to find information about how to block or limit cookies, visit AdChoices, the Canadian self-regulatory program for online interest-based advertising, administered by the Digital Advertising Alliance of Canada (DAAC).

What about links to other websites?

Our Apps and our Sites may contain links to other websites that may be subject to less stringent privacy standards. We cannot assume any responsibility for the privacy practices, policies or actions of the third parties that operate these websites. We are not responsible for how such third parties collect, use or disclose your personal information. You should review the privacy policies of these websites before providing them with personal information.

How do we use your personal information?

The personal information collected is used to provide, support, and personalize our Apps, our Sites, and our Services, and to make our Apps, our Sites, and our Services and advertising more relevant and useful to you and others.

We do not sell your personal information to any third parties. However, we do share some information with trusted third parties who assist us in operating the App and these Sites, conducting our business, or servicing you, so long as those parties agree to keep this information confidential, use it only for the purpose for which we disclose it to them, and to process the personal information with the same standards set out in this Privacy Policy. We may also disclose your personal information when we believe such release is necessary to comply with the law, enforce the App’s and these Sites’ policies, or protect ours or others’ rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

We may collect, use, or disclose your personal information without your knowledge or consent where we are permitted or required by applicable law or regulatory requirements to do so.

Some of the personal information we collect may be transferred to, stored or processed in jurisdictions outside of Canada and Quebec, including the United States. As a result, this information may be subject to access requests from government, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions.

We may, as reasonably necessary or helpful, collect, use or disclose personal information to ensure the integrity of our systems, to investigate abuse of our service, to detect, suppress or investigate fraud or any violation of our terms of use, and to assist others with such activities. We may disclose personal information to law enforcement where we determine it is reasonably necessary to report or investigate an offence.

Access and Correction

We will take reasonable steps to ensure the personal information we hold is accurate, complete and up-to-date. Upon your written request, and subject to certain exceptions provided by law, we will inform you of the existence, use, and disclosure of your personal information and give you access to that information. We may charge a minimal fee for providing such access to you. If you believe that the personal information that we hold about you is not accurate or complete, you may reach out to us as outlined below. If you are able to establish that the information is not accurate or complete, we will take reasonable steps to delete and/or correct the information so that it is accurate, complete, and up-to-date. In order to facilitate a request to correct or update information, we may ask you to provide additional information to confirm your identity. Any such information will only be used for the purpose of confirming your identity and will not be retained by us.

Retention of Personal Information

The personal information that you provide will be retained as long as necessary for the purposes for which it was collected or to meet legal requirements. However, we will take reasonable steps to destroy or permanently de-identify personal information we hold if it is no longer needed for the purposes for which it was collected.

Consent

By submitting personal information to us, or our service providers and agents, you consent to the collection, use, disclosure, and transfer of your personal information in accordance with this Privacy Policy and as permitted or required by law. You may withdraw your consent at any time to the collection, use, disclosure, or transfer of your personal information time by contacting us at [email protected]. If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that we may not be able to provide you, or continue to provide you, with certain products, services, or information that may be of value to you.

How is your personal information protected?

We endeavour to maintain technical and procedural safeguards that are appropriate to the sensitivity of the personal information in question. These safeguards are designed to prevent your personal information from loss and unauthorized access, copying, use, modification or disclosure.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot warrant the security of any information you transmit to the App or these Sites, and you do so at your own risk. Once the App and these Sites receive your transmission or personal information, we make commercially reasonable efforts to ensure its security on our systems.

Interpretation of this Privacy Policy

Any interpretation associated with this Privacy Policy will be made by WeyMedia Inc. This Privacy Policy includes examples but is not intended to be restricted in its application to such examples; therefore, where the word "including" is used, it shall mean "including without limitation."

This Privacy Policy does not create or confer upon any individual any rights, or impose upon WeyMedia Inc. any obligations outside of, or in addition to, any rights or obligations imposed by Canada's federal and provincial privacy laws, as applicable. Should there be, in a specific case, any inconsistency between this Privacy Policy and Canada's federal and provincial privacy laws, as applicable, this Privacy Policy shall be interpreted, in respect of that case, to give effect to, and comply with, such privacy laws.
